Star Chamber Anyone?

From a comment on this blog post from The Volokh Conspiracy.  The Post title is "You Can’t Read This Opinion".  The opinion came from the US Court of Appeals for the DC Circuit and the case was Abdual Latif v. Obama.  For those whose minds bend in a certain direction, this is almost certainly not about the birth certificate.

Over at the Lawfare blog we have this factoid:
A docket entry explains that there is a classified opinion consisting of a 53-page opinion for the court by Judge Janice Rogers Brown, a 14-page concurring opinion by Judge Karen LeCraft Henderson, and a 45-page dissent by Judge David Tatel.
Another Commenter at The Volokh Conspiracy summed it up this way:
Si Ego Certiorem Faciam...Mihi Tu Delendus Eris.
In English, "I could tell you, but then I would have to kill you".

Star Chamber?  The Wikipedia entry linked to, uses the term "pejorative", as well it should.

Things like the recent killing of Anwar al Awlaki and this item raise questions as to if our legal system is wandering off the tracks and will soon come back to bite innocent citizens in the privacy of their own homes.

Not yet and maybe never. But possible.

  1. I like the post "Nothing says transparency and due process like secret law." So, if I can quess, this poor chap who took on the Great Pumpkin is now imprisoned for his life but not allowed to know why. Boy, what a beacon for freedom we've become. This, and last week the "revelation" that we have a "secret panel" that decides who needs "official killing."

    I'm just guessing that the faith and confidence in the integrity of Big Government is probably just about like our national economy.....bankrupt.

    Like little lemmings....we are racing mindlessly toward the cliff and oblivion.....is THIS part of that promise to "fundamentally change the United States of America"? So far, he is doing a wonderful job of fulfilling THAT promise. I guess his pathological narcissism just can't allow Bush/Cheney to lead history in hackneyed, over the top government actions. Oh...sorry.....THAT is Bush's fault too.
