Individual Mandate Survives—As A Tax

Interesting.  The good news is the use of the Commerce Clause was struck down.  But, the individual mandate survives as a tax.  I thought Congress told us it wasn't a tax.  But then Ms Pelosi apparently hadn't read the bill before it was passed.

Looking back in history:

OBAMA: No. That's not true, George.  The — for us to say that you've got to take a responsibility to get health insurance is absolutely not a tax increase.  What it's saying is, is that we're not going to have other people carrying your burdens for you anymore than the fact that right now everybody in America, just about, has to get auto insurance.  Nobody considers that a tax increase.  People say to themselves, that is a fair way to make sure that if you hit my car, that I'm not covering all the costs.
I guess Ms Pelosi was right about having to pass the ACA bill to know what it says.

  1. What insight by Shawn? This ruling isn't like the City of Lynn, Shawn came out the way he went in.

    I take Pelosi to mean the law will evolve. At some point, Americans will get the kind of health care Congress gets.

  3. It is unlikely you would get banned for the occasional use of le mot de Cambronne, but citing our Senior Senator as authoritative might trigger such an action.

    As for Minority Leader Pelosi, I take her at her plain words.  Your suggestion gives her credit for far more foresight than she deserves.

    My question of the moment is, how many women will drop out of the work force as a result of ACA going into effect?

  6. The good news is that everyone will now get their "free" healthcare....just like Congress and the military retired folks. The bad news is....they are about to discover that it isn't FREE. It is a tax....and a rather huge and growing one at that.....and this one is not George Bush's fault..but it will devastate a percentage of the elusive and dying "middle class"....and the poor...well..if you read the SCOTUS opinion....they are left out there as there are "issues" with the Medicare expansion.

    Good that the Commerce Clause game has been called...but it only allows the Prez to just tax the living daylights out of folks to implement his purely socialist agenda.

    The BEST news is that the SCOTUS opinion will actually work very strongly against King Barack's reelection and permanent ascendancy as our very first monarch to the newly minted Throne of the United Socialist States of America.

  8. The "Act" will quickly become known at the "UNAFFORDABLE Care Act" and rather than establishing or reinforcing a foundation for American families, it will serve only as sand, quickly undermining that venerable institution of American society.

  9. Health Insurance just seems to get more and more complicated. I know it is better to have it, but more and more I don't see the benefit since I fight all the time with the managing of care. I don't know what is or isn't covered until I get the bill, doctor offices what your credit card 'on file' just to charge whatever the insurance doesn't.

    I can't say I know what this will bring.

    I do make a snarky joke all the time to my mother now well past menapause that her birth control has been covered in Massachusetts, whenever she complains.

    Off subject MIT is working on a filter for waste treatment plants for all synthetic estrogen from the Pill, that is destroying the enviroment and reducing the sperm count in men.

    Contraception, like being dependent on middle east oil despite alternatives, so much for preventative health.

    The Catholic Church may have its scandals, but its teachings are way too perfect at times that it gives me the spiritual chills.

    We don't have to convince you, as it is almost impossible to reason someone out of an opinion that they arrived to without using reason.

    So, we will see you on election day. If you don't like the America we are making, revolt or emmigrate.

  11. WOW...the standard liberal Democratic party response. The problem is that liberals have forgotten that they actually MUST share "their" America with folks who don't agree with them. Your mandate that I have only two choices, revolt or emigrate shows the true philosophy behind your political agenda..."My way or the highway"....Yup..real American. I can assure you, very, very few of the millions like me have any plan to emigrate.

    America is evolving. I dare Neal to pick a date in American history that would represent his "pinnacle." No exceptions. Pick a date and propose how it was the "perfect" America.

    PS. I hear Somalia is a libertarian paradise.

  14. There is no date as there has never been a "perfection." HOWEVER, what libertarians and conservatives want.....and liberals and progressives despise.....it the absolute minimum amount of government necessary to provide for the security of the republic. Liberals want the government to do it all. More government is always the liberal solution to the problem.....as it was in the days of British rule.

    This is NOT about socialized medicine. It is about a government gaining the power...the absolute power..to dictate every aspect of the individual citizen's life.

    What this ruling has done is to set the stage for that very thing. GM not selling enough cars? Fine....government won't make you buy a GM car, but if you don't, you will have to pay a "penalty" for not doing do. Oh...it's not a tax. It's a penalty. Don't like broccoli? Fine, pay the broccoli penalty and you don't have to buy or eat it.

    This is the kind of "flexibility" that Obama was speaking of acquiring when he talked to the President of Russia.

  15. Sad. You see your "liberty" put in opposition with the health and welfare of millions of Americans. Yet, you chose liberty for you?

    We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.


    I see more "We" freed by ACA.

  16. "Freed" is hardly a term I'd use.....more like driven into bankruptcy by skyrocketing taxes..much of which will be as a result of Obamacare.

    The problem with trying to discuss anything with the left is their insistence on always being right.
