For John, BLUF: Is the IRS out of control or is it that the President is failing to take care that the laws be faithfully executed? (Article II, Section 3) Nothing to see here; just move along.
Today is Day 1039 of the IRS Scandal. The Tax Prof Blog, Professor Paul L Caron editing, talks about the IRS distorting the law and its rules to favor certain groups.
Here is the lede:
In a letter sent today to the Internal Revenue Service Commissioner, Democracy 21 joined by the Campaign Legal Center criticized the IRS’ decision made without explanation to grant recognition to Crossroads GPS as a “social welfare” organization under section 501(c)(4) of the Internal Revenue Code. And here is how the blog post winds down:
The letter concluded:Well the proper Progressive groups. With this latest ruling, the IRS appears to have abandoned this statutory requirement altogether. This has resulted in the IRS issuing what amounts to a blanket invitation to section 501(c)(4) groups to violate the tax laws with impunity, and thereby acquiescing to the unfettered spending of secret money in federal elections by social welfare organizations. The country deserves better from the IRS.
Has it always been this way, or is it that the Internet has allowed more people to learn about this kind of pernicious behavior on the part of our Bureaucratic overlords?
Hat tip to the InstaPundit.
